Status of Legislation to Ban or Limit the Sale of Novelty and Toylike Lighters

Indiana has introduced legislation banning or limiting the sale of novelty and toylike lighters.

2013 Legislative Session

Jan 7: Indiana Representative Randy Frye introduced House Bill 1078 which makes the retail sale or distribution of a toylike lighter a Class C infraction. The Bill states that the State Fire Marshal or a designated law enforcement officer may enforce toylike lighter laws. House Bill 1078 authorizes the fire prevention and building safety commission to adopt rules to implement the toylike lighter law.

2012 Legislative Session

Jan 17: Indiana House Bill 1056 unanimously (11-0) passed the House Veterans Affairs and Public Safety Committee.

Jan 4: Indiana Representative Randy Frye introduced House Bill 1056 which requires the State Fire Marshal to make a list of novelty lighters. The Bill makes the manufacture or import of a novelty lighter for sale, distribution or resale a crime with the funds collected as judgments for novelty lighter infractions to be deposited in the fire and building services fund.
